Every week we read of cases where employers have been ordered to pay significant penalties. This is where the disciplinary process followed has resulted in the employee taking personal grievance action, claiming they have been unjustifiably dismissed or disadvantaged. The law is very specific, not only requiring justification for disciplinary action, but necessitating that the process followed is fair.

This course will cover how to effectively manage the disciplinary process.

Learning outcomes

  • Understand procedural fairness and justifiable reasons for initiating disciplinary action.
  • Improve supporting documentation such as letter-writing, note-taking and investigative materials.
  • Be equipped with techniques to manage disciplinary meetings and investigations.
  • Understand how to avoid personal grievance claims on unjustifiable disadvantage, unjustified dismissal and constructive dismissal.
